The
Katsina State High Court monday restrained the state government from
dissolving 34 elected council chairmen and 361 councilors in the state.
The High Court sitting at Funtua and presided by Justice Maikata Bako
ruled on an ex-parte application filed by states Peoples Democratic
Party (PDP) challenging the power of the state government to dissolve
the councils.
In his defence, counsel to the
PDP, Mr. Uyi Eguma, said his client was seeking for an interim
injunction restraining the defendants from dissolving elected chairmen
and councilors pending determination of the substantive suit.
Uyi said the application was filed pursuant to Order 32 of Katsina State
High Court Procedure Rule and prayed the court to exercise its judicial
powers.
Joined in the suit as defendants are the state governor, the state Attorney General and the state House of Assembly.
The presiding judge, Justice Bako granted the payers of the
plaintiff/applicant (PDP) and adjourned the case to July 28, 2015 for
hearing.
